Purposes and Legal Basis

ProMakers® will process your personal data based on the following legal grounds and for the following purposes. You can access our Record of Processing Activities in accordance with our commitment to transparency.

Performance of the contract — Art. 6.1(b) of the GDPR

Required steps to use the platform as a Music Creator or Talent Scout. Includes:

Registration on the platform and profile management.
Informational communications regarding the platform.
Questions, suggestions, and complaints.
Sending newsletters and promotions related to ProMakers®.
Communications required by regulations or authorities.
Market analysis, navigation, and usage statistics.

Required fields — Certain information is required to complete your registration as a Music Creator or Talent Scout. Without this information, you will not be able to use the services. All information you provide must be accurate and up to date.

Consent — Art. 6.1(a) of the GDPR

Optional treatments that you can enable or disable at any time:

Geolocation. GPS-based location tracking to provide you with relevant results based on your current location.
Marketing communications. Promotions for products or services other than those offered on the platform.
Non-essential cookies. Can be managed through the cookie preferences panel.

Legal obligation — Art. 6.1(c) of the GDPR

Required compliance areas: money laundering, criminal liability, consumer protection, civil, and commercial law.

Legitimate interest — Art. 6(1)(f) of the GDPR

Chatbot support (anonymous process), handling complaints and mediating disputes between users, improving service quality, providing information on related products, and monitoring for fraudulent or unfair activity.

Source of the data

In most cases, we collect your data directly from you, either through forms on the platform or after you have set your preferences. We recommend that all information be accurate, truthful, and up-to-date.

For supplementary purposes, certain information may be inferred or aggregated by third parties: registration via social media, service monitoring, obligations of the payment processor, or preferences managed by our providers.

Music Creatives — As a Music Creative, you are responsible for complying with data protection regulations regarding any personal information you may obtain from Talent Scouts or third parties involved in your transactions. ProMakers® is not liable in this regard.

Recipients

As a general rule, personal data will not be disclosed to third parties, except where required by law (judges and courts, administrative bodies, or supervisory authorities).

Technology providers — Required to provide the service. Due diligence has been conducted to ensure compliance with privacy regulations.
Between users — To operate the platform’s services. It is strictly prohibited to use this data for any purpose other than those agreed upon. ProMakers® will take the necessary measures—including account suspension or deletion—in the event of any unauthorized use.

Conservation

▾

The data will be retained for as long as necessary to fulfill the purpose for which it was collected and to determine potential liabilities, in addition to the periods established by applicable regulations.

At the end of the retention period, the data will be anonymized and/or blocked in accordance with legal requirements.

International transfers

▾

No international data transfers are anticipated. Should they be necessary, ProMakers® will take the necessary measures and comply with legal requirements to ensure they are carried out in accordance with European and national privacy regulations.

You warrant that you have informed the third parties whose data you provide and that you have their authorization.

Music Creatives — As a Music Creative, you are responsible for processing the personal data you obtain from Talent Scouts or third parties involved in your transactions, whether on or off the platform. ProMakers® is not liable in this regard.
